Terms of Service — FundedFutures

These Terms of Service ("Terms") govern your access to and use of FundedFutures, operated by Funded Futures ("Funded Futures," "FundedFutures," "we," "us," or "our"), including our website, mobile experiences, AI coaching features, and any related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

About this agreement & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to payments and handles billing, taxes, and refunds. Your purchase is also subject to Paddle's Buyer Terms and Refund Policy.

1. Eligibility & Accounts

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. You agree to provide accurate information, keep your credentials secure, and are responsible for all activity under your account.

2. Subscription Plans & Billing

FundedFutures offers a free tier and paid subscription plans ("Premium"). Premium is billed in advance on a recurring monthly ($9.99/month) or annual ($99.99/year) basis at the price displayed at checkout, plus applicable taxes. Billing, invoicing, tax collection, and payment processing are handled by Paddle as the Merchant of Record. By starting a Premium subscription you authorize Paddle to charge your payment method on each renewal date until you cancel.

Prices may change. We will provide reasonable advance notice (at least 30 days) of any price increase, and the new price will take effect on your next renewal. If you do not agree to the new price, you may cancel before it takes effect.

3. Free Trials & Promotions

If you start a free trial, you must cancel before the trial ends to avoid being charged. Trials and promotional pricing are limited to one per user and may be revoked for abuse.

4. Cancellations

You may cancel a Premium subscription at any time from your account settings. Cancellation stops future renewals; your Premium access continues until the end of the then-current billing period. We do not provide prorated refunds for partial billing periods except as required by law.

5. Refunds

Subscription fees are generally non-refundable. Limited refund eligibility is described in our Refund Policy, which is incorporated into these Terms.

6. User Conduct

You agree not to:

use the Service for any unlawful, fraudulent, harassing, or harmful purpose;
misrepresent your identity, eligibility, or academic record;
scrape, copy, or redistribute scholarship listings, AI outputs, or other Service content for commercial use;
attempt to reverse engineer, decompile, or circumvent security or rate limits;
upload malicious code or interfere with the Service's operation;
use the Service to submit applications or essays you did not write or are not authorized to submit; or
resell or share access to a paid account.

We may suspend or terminate accounts that violate these Terms, with or without notice, and may report unlawful activity to authorities.

7. User Content

You retain ownership of essays, profile information, and other content you submit ("User Content"). You grant FundedFutures a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process User Content solely to operate, secure, and improve the Service for you. You represent that you have all rights necessary to grant this license.

8. Intellectual Property

The Service, including software, design, scholarship summaries we author, brand names, logos, and the FundedFutures and Funded marks, is owned by FundedFutures or its licensors and is protected by U.S. and international intellectual property laws. Except for the limited right to use the Service under these Terms, no license is granted to you.

9. AI Features

Certain features use generative artificial intelligence ("AI Features"), including the "Funded" AI coach. Your use of AI Features is also subject to our AI Disclaimer.

10. Scholarship Information

FundedFutures aggregates and summarizes scholarship opportunities from third-party sources. Your use of scholarship information is subject to our Scholarship Information Disclaimer.

11. Third-Party Links & Services

The Service contains links to third-party websites (including scholarship sponsors, application portals, and FAFSA). We do not control and are not responsible for these third parties, their content, privacy practices, or availability. Your interactions with third parties are solely between you and them.

12. Beta & Experimental Features

We may label features as "beta," "preview," or "experimental." Such features are provided "as is," may change or be discontinued at any time, may contain bugs or produce unreliable output, and are not covered by any service-level commitment. Premium plans do not entitle you to any specific beta feature.

13. Disclaimers & Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT YOU WILL RECEIVE ANY SCHOLARSHIP, FINANCIAL AID, ADMISSION, OR OTHER OUTCOME. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, ELIGIBILITY CRITERIA, AWARD AMOUNTS, OR DEADLINES OF ANY SCHOLARSHIP LISTED.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FUNDEDFUTURES AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES (INCLUDING LOST SCHOLARSHIPS OR AID) ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless FundedFutures and its affiliates, officers, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your User Content, (c) your violation of these Terms or any law, or (d) your violation of any third-party right.

16. Termination

You may stop using the Service at any time and delete your account from settings. We may suspend or terminate your access at any time, with or without cause or notice. Sections that by their nature should survive (including IP, disclaimers, liability limits, indemnification, and governing law) will survive termination.

17. Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. You and FundedFutures agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to arbitration, except that either party may seek injunctive relief in any court of competent jurisdiction.

18. Changes to the Terms

We may update these Terms from time to time. If changes are material, we will notify you (for example, by email or in-app notice) before they take effect. Your continued use of the Service after the effective date constitutes acceptance.

19. Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

20. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, Scholarship Information Disclaimer, AI Disclaimer, and DMCA Policy, constitute the entire agreement between you and FundedFutures concerning the Service and supersede all prior agreements.
